Not really. Anyone that seen the poster sees that 2K3 Shredder is in the background. Plus we hear Shredder's voice at the end of the trailer, hell he's in the trailer.

And everyone would suppose him being in the movie, 'cause it wouldn't be right to leave 2k3 Shredder out if 2k3 TMNT is in the movie ;) And there is an proper explanation to his return, at least what I happen to remember from that audio Rose gave to us :)
