Sakurai only put Snake in Brawl as a favor to Kojima. With Kojima no longer at Konami and him probably no longer having any interest in Smash, it was likely deemed impossible from the start. Its also possible Sakurai didn't want to bring Snake back either.

Kojima and Konami are at war, and Sakurai probably doesn't want to go behind Kojima's back.

Snake is in limbo. Kojima killed Snake. Konami killed Snake.

The moment David Hayter didn't come back for MGSV to voice Snake, we knew it was all downhill from there.

Kojima screwed over David Hayter, Kojima screwed over Big Boss, then Konami screwed over Kojima, and then Konami screwed themselves up due to all the negative press they received for the whole situation.

MGSV's development hell and Kojima's fallout with Konami was more interesting to watch than the game itself.

There's a lot more hell for Konami outside Metal Gear, especially towards Castlevania and their treatment to employees in Japan. Anyone who believed Snake was returning despite no Konami involvement..... well something something. I still wished Brawl had a Castlevania character, Snake while I preferred over Sonic in the game still didn't fit the whimsical universe of Nintendo. He's had history with Nintendo I understand, but it felt extremely jarring despite the enjoyment I got when playing with him.

I wish they could salvage Snake's moveset at least and give it to a new character. Even if Snake never returns, his actual moves and specials could be salvaged and given to a new character.

Pichu and Young Link can stay back in Melee, we don't need them. Snake probably with never come back due to Konami. Squirtle and Ivysaur could return but it's unlikely considering that there is already 6 Pokemon. (Or Lucario could be cut and replaced with Squirtle...)

Wolf and Ice Climbers I'd like to see come back.

It's even worse when people do it before a game comes out. People are already doing it with King of Fighters 14. 10/50 characters have been announced and people are already pissed because they haven't revealed X character.
