It was in 2014. All licenses are obtained. Our books are absolutely legal.

I talked to Don about this on Facebook, he didn't know about this.

He also pointed out that he outright owns Pteroman and the Cave Babes (though its not clear if the story with them was included in any of the Russian trades or not).

It wouldn't be the first time a legal slip up like this occurred with TMNT reprints. IDW reprinted the Mark Martin issues with out getting his permission regarding Gnatrat, for instance. And Paul Jenkins never signed away the rights to his TMNT work (but he is not bothered much by this).
