Here's my morality.
If someone sends something to me, and doesn't ask for it back, I keep it. If they do ask for it back, I send it back.

I've got enough of my own life problems to deal with. Make it easy for me to do the right thing in response to your mistake, and I will. Don't ever say a word about it? Well, guess it was a gift then, thanks, I'm not going to take on another part time job of reaching out to fix your mistake.

There's personal ethics and then there's the law. I've read enough now, including the 2nd wave of armchair legal expertise going around, to conclude that the 1st wave was wrong. If you got one by mistake, you're not legally entitled to keep it. The paragraph everyone wants to be true is in fact for a different situation than this. The facts of this scenario do not support "free for all" interpretation. Everyone is free to make their own armchair legal conclusions but good luck avoiding that charge if they try...they won't succeed.

you're spinning it People get ignored by NECA when they need real customer service for things they purchased. Now NECA is emailing everyone because they want their money. Screw them! It's called KARMA. Maybe if NECA showed some "morality" and not just telling customers to get lost when they need help with QC or missing parts, they'd might get a better response.

you do realize that NECA waited 2 months to decide to come after people for their extra labs? It took them 2 months to realize they double shipped stuff?

It’s not like they shipped 2 labs together in the same box or even at the same time. They shipped 1 lab in August/September and then a 2nd in September/October. I ordered 1 lab. I received that 1 lab. I then received a 2nd lab on my porch one day without any notice.

NECA can not charge my card for this. And when you use pay in 4 with shop pay or Apple pay, they don’t have your card on file. And even if they have it on file, they cannot just use those cards to charge customers for unauthorized purchases.

Unfortunately, NECA is legally entitled to retrieve their merchandise at their expense, and they can also legally charge people who don't. Radiohead had a similar situation with W.A.S.T.E. (handled much better than what NECA's done, mind you) a few years back and they were able to successfully charge the people who wouldn't send it back, even in spite of it being their error.

I don't know. My main problem here is the apparent incompetence of their shipping team and then also how aggressive they were in that very first email. They should have just been apologetic and given the return label and left it at that initially. The fact that they apparently waited no time at all to send the second, even more threatening email is insane to me.

Yep, I would never defend the way this was handled. NECA deserves criticism and to lose business over that.

And yep, I imagine there are situations where charging people again won't work. If you really want to foil their plan you can also try canceling your credit card and see if that saves you.

Disputed CC charge probably will NOT work. I've done a lot of those in my day and they aren't as easy to get through anymore, especially for larger amounts, and NECA has documentation to provide the investigators.

2 months sounds like a long time. But first that's an exaggeration...counting begins the moment the 2nd one arrived, not the 1st one, and at any rate the only reason you might not still have it is that you immediately scalped it in which case you are a thoroughbred scalper so nobody here should be defending you. Are we meant to believe hard-core NECA collectors immediately open or re-sell their items? That's a laugh! But also, if you scalped it already, then you can theoretically afford the coming charge.

Full disclosure, I am one who received a second Donnie’s Lab. And yes, I have sent it back.
Here’s the full timeline for perspective-

My original order for Donnie’s lab arrived June 24th.

On 10/3, my UPS app notified me that there was a box from NECA heading my way, which I found odd since I had nothing expecting to arrive at that time and it was large so I knew something was off.

On 10/8, the box arrived, just dumped on my porch, fortunately I was home. Sure enough I was surprised it was a second lab. I had to repeadiky assure my wife that I didn’t order it. I checked NECA and credit card accounts to verify that there was no order for it and then I emailed customer service stating that I got a duplicate order and what should i do and if they wanted it back on that same day it arrived. I did not open the box other than to cut the tape on the putter shopping carton to confirm that it was indeed a lab playset as printed all over the sides of the shipping carton. I left the playset still factory sealed, wrapped in its outer protective shipping bubble wrap and still inside the shipping carton untouched.

I did not get any response at all to that customer service email. I started seeing all over the web about others receiving it as well and knew this was probably going to become a thing. I left the extra lab as described above and stashed it aside and left it alone.


On 11/20 I got the first email, as seen around the web, which also stated that it had an attached return label, which the email did not. Felt the $100 credit was fair, but was not a fan of the passive aggressive statement further in the same email. Regardless, neither was the deciding factor for me returning it.

I emailed customer service asking for them to the return label attachment so I could send back the lab. No direct response to that email, but on 11/21 I got the slightly revised version of the first email that said to watch your inbox for a separate email with a shipping label. Still states to please return at your earliest convenience.

On the night of 11/21, I got an email from tracking(at)shipstation with a personal return usps label with my name and home address preprinted as the sender. I print it, apply it to the original shipping box as untouched as it’s been since day one and seal it securely for shipping. I plan to take it to the post office on Monday the 25th

11/22 second email, the more hostile version with threats and deadlines arrives it the early afternoon. It also no longer mentions the credit. I question if NECA will get crediting accounts correct, and what happens if even with sending this back if they won’t screw up and black list my account and try to charge me? I also see more than one person online state that they were getting all these same emails but didn’t get a second lab (hopefully they weren’t porch pirated since there was no notice of these arriving unless you have ups alerts set) which has added to my concern.

On Sat morning, 11/23, I take the lab to the post office wanting to be done with it. I set tracking number alerts to email both me and NECA at every single scan and for delivery.

On Monday 11/25, NECA got my extra lab back as confirmed by USPS tracking. I emailed NECA to please confirm its arrival and acknowledge that fact to my account (meaning take mine off the “we are going to black list you” list)

No response.

Sent a similar email again today asking for confirmation of its receipt and asking when I could expect to see the credit.
It’s been a few hours, no response so far.

I will update when there is something new.

Yeah, those that sent theirs back will be jumping through hoops to get that $100 store credit (which will likely be only eligible towards crap that's been sitting a while and doesn't sell well)

Are there any updates beyond being displayed at SDCC of Tattoo or Wrym? I am itching for new characters instead of remakes or army builders of this series.

Still amazed that NECA can't figure out how to combine the cash grab with real fan-service - like hello? Where is the Foot Soldier 4-pack?

Not that I'd support it at this point, but I'm just pointing out things that scream "obvious".

From the NYCC display, it sounded like Panda, Shredder and the Tattoo/Wrym 2-pack were going to be Q2 2025 releases.

Not until April/Easter season. That sucks and its just the one two pack at that.

I'm thinking next Haulathon we'll see new sets, unless NECA has been 100% booted out of their stores for 2025 (which is a rumor)
