Problem as a buyer/seller on e-bay?

I'm wondering what sort of situations you guys have had to deal with, and how they were resolved. I got this message this morning:

Half the reason the items were worth any money is because the boxes were in tact so you ruined them by putting sticky tape all over them. And most importantly the raphael figure was covered in sticky tape and clearly broken in areas that a poor attempt was made to glue it back together.

This is my first negative experience with ebay and unless you contact me and come to an agreement what I have previously stated will be the result.

Now, several of you have dealt with me on here in the buying/selling/trading section and I have 370 positives on e-bay as well (I have 100% positive feedback) and I really don't feel that this guy has much of a case. It cost him $50 for the items and $50 for shipping. I've offered a $50 partial refund if he drops this, which I feel is fair-- he'll have no problem re-selling the two giant Fightin' Gear figures he bought from me so long as he didn't f*ck them up himself as a means of winning his case. Also, I don't know what happened when they went through customs. I do know that the figures, while not in PERFECT condition, were in very good shape when I mailed them despite having a small amount of cosmetic work done. I said I would ship them in their original boxes, I never said that I would go out of my to protect said boxes. I only hope that the person that I sold my three "naked" deluxe turtles to doesn't come at me with the same complaint in a few days.

As a seller, how worried should I be that I'm about to get f*cked up the @$$?

CJJ, when I sell boxed stuff, my practice is to completely wrap the box in bubble wrap (the big bubble kind), surround it by packing materials, then box it up tightly. So I can kind of see where the guy is coming from if the boxed stuff wasn't packed very well.

On the other hand, if you posted photos of the items, it's on the buyer to review those photos and determine whether their condition is worth paying for.

I ran into a situation where I sold some Smurf curtains to a lady in Australia (I'm in the US). Shipping costs far outweighed the cost of the item. She washed the curtains and they fell apart, and she tried to file a complaint. It went nowhere, but to eliminate any bad blood, I offered a full refund - if she would ship the curtains back. She refused.

Didn't affect my feedback either way.

I think your refund offer is fair. If he objects, call his bluff and tell him to go ahead with the negative feedback. Your positives will outweigh the single negative.

I would agree with CA... If the pictures are what you sent and you accurately described the item then you shouldn't worry... But if what the buyer says is true and there is glue/sticky stuff all over and it's from something you did, then I would expect a full refund (granted the buyer sends the items back)... I would ask the buyer to take pictures and send them to you, then you can compare them to the auction photos and make your decision that way... Who knows this guy could be blowing smoke and just wanting some of their money back...

If you seriously didn't pack the figures in a box, you deserve to lose. And I'm shocked that you would have this attitude about shipping/selling when I know you would be pissed as hell if you bought a packaged figure and the seller bent the card or otherwise shipped it in a manner that was sure to damage it somehow.

It does not matter one bit how good of a "deal" you claim this person to have gotten, you clearly did not fulfill your duties as the seller.

I went into this thread expecting to give you some sympathy, because on eBay when stuff like this happens, the seller is 100% guaranteed to get screwed. But this is clearly your fault. Resolve the case ASAP for the least damage you can get away with and be done with it.

Yeah I gotta agree with Rose on this one. You don't ship an item wrapped in paper over seas. For one it's obvious he purchased them because they were MIB. Stuff gets damaged on transit. Merely sending it in it's original packaging and some paper alone is asking for trouble. I've had stuff that came from no more then 50 miles from where I live arrive in a damaged box. Of course you wouldn't state in your auction that you will go extra lengths to package items, as a seller it's expected of you.

You didn't package it right simple as that. A full shipping refund is a fine deal in my opinion. As far as the package modification goes I'm not sure how to speak to that. Even if you posted pictures you should have clearly stated in the auction that the package had been modified. This might cause problems.

You as a seller is responsible for those items. You make sure the condition of what you send out is in the same condition when it arrives to its destination or you face consequences such as this. It is an obligation to protect those items, not an extra fee or service to tack on because you can't be bothered otherwise.

With that attitude and having disclosed you cannot be bothered to pack the items properly, I say you deserve to have to refund partial or full of the buyer's money.

As a person who has dealt with you many times, I'm surprised to see this. I have always had a positive transaction with you, so I don't know why you would do something like that, that doesn't make sense. As the people above me have already stated as a seller it is your DUTY as a seller to protect the items you sell. You don't have to "say" anything about protecting the items, it's expected. But why would you not protect something that is being shipped overseas, you should've seen this coming man. And yeah, you're gonna get ****ed up the (A)$$ pretty hard. If you don't come to an agreement, Ebay is gonna side with this guy and they should.

Actually...you're all wrong. :tlol:

First off, the items were advertised as USED because they'd been opened and used as display items. The boxes have been moved around quite a bit-- I sell items that are loose/complete/stored in their original packaging ALL THE TIME and used means used. I have sold quite a few lots of loose/complete 2K3 figures and nobody had complained thus far because I bent back the cards in order to fit them into whatever box I had available at the time. All they care is that the packaging is included )as advertised) and the figures are complete. I advertise the figures as being mint (regardless of having been opened), not the packaging. That's ridiculous!!!

The belt on Raphael is clearly broken and covered in what looks like glue to hold it back in place. After an hour and a half of slowly removing the sticky tape from the boxes I have succeeded with minimal damage. $50 will be suffice as it is about half of the total expensives this has cost me, and I believe I have 1 of the 2 items I purchased up to scratch. Once the refund amount has cleared I will post you positve feedback as this will be a positive outcome from our dilemma.

Please in future try to be more accurate, I am a collector and used only for display is not exactly what you just told me happened to these figures.

Thank you for your cooperation and you will receive positve feedback once this is cleared.

Regardless of this, I probably have better feedback on e-bay (and maybe on here) than ANY of you.

Actually, your wrong. Ebay will ALWAYS side with the buyer. And since you were lazy with shipping and so careless, you lose this one.

Samhain is right about this. Just because you were lazy with packaging and thought people you've dealt with before are okay with you f*cking up the original box, doesn't mean every collector would be okay with this. Also, I'd be a little more specific when putting a description of the product up on ebay. Do some actual work, you're getting money for your product.

You guys are really starting to try my patience.

Hahaha, what's wrong with you man? You come on here and post your problem, turns out you're in the wrong with your piss poor shipping choice, people tell you so and we're testing your patience? Were we just supposed to take your side? You ****ed up, admit it and move on.

I really like this thread. It's awesome.

Powder 10-14-2010 10:07 PM

I agree with everyone who is against you, basically.

***First of Two Latin Kings*** 10-14-2010 10:11 PM

Wow. That's something.

I wanted to give you a chance to be in the right but with you saying this right here I will personally never buy anything from you again and will never recommend your sales to anybody else. Take your high and mighty elsewhere.

ROTFL. Really? You want to compare your weak 372 rating to my 1484 rating that goes back to 1997? Really?

:tlol:

Katie 10-15-2010 10:28 PM

I'm personally awed by the majestic feedback of CJJ. I mean.......how can ANY of us ever compare to someone so obviously great?

[/sarcasam]

Hope you learn from this...and buyer beware of this guy
